All prices are quoted prices in US dollars unless stated in overseas currency.

Active Asia Tours utilises local suppliers for all travel arrangements.

Here at Active Asia Tours, we are a booking website for tours to Vietnam and Cambodia. Any reservations on this website indicates your acceptance of all our terms and conditions as detailed below. Our local offices in Vietnam (Active Asia Vietnam) and Cambodia (Active Asia Cambodia) are independently owned and operated by local families.

For the purpose of these terms and conditions the term ‘we’ or ‘us’ refers to Active Asia Tours and all regional offices. The term ‘you’ or ‘client’ refers to you and your travelers when booking arrangements on this website.

1. The Contract

‘We’ undertake to perform all services with reasonable care and skill. ‘We’ act as a booking agent for all hotels, tours and services. ‘We’ will not be liable for any loss or damage, which results from taking part in these services. ‘We’ have exercised all care to ensure the information is correct, accurate and up to date. ‘We’ cannot be held responsible for loss, damage or disruptions outside our control. All hotels have been researched and are recommended at the time of travel, but conditions can change.

All persons (hereafter called the client) will be bound by the conditions, which follow.

2. Responsibility

All services are organised by ‘us’ . Notice is hereby given that all arrangements are made on behalf of ‘you’, the clients, on the sole condition that the we the organisers shall not be held responsible for any injury, death, accident, delay, loss, damage or irregularity. ‘We’ act as an agent for transport companies, hotels and other contractors and shall not be held liable for any injury, damage, loss, delay or irregularity that may occur, including, but not limited to, any defect in vehicle or any other form of transport conveying a traveler, acts of God, weather disruptions, detention, delays or expenses arising from quarantine, strike, theft, civil disturbance, government restriction, strikes, riots or epidemics or regulation. Or for any accident by aircraft, boat, bicycle, motor vehicle or any other form of transport or in any hotel or guest house, pension, or other form of accommodation.

3. Payment

Payment in full will be required at time of booking. Payment is processed in US Dollars but may be converted to local currency by ‘your’ credit card provider. ‘We’ are not responsible for any additional fees or charges applied by your bank or card provider after your transaction.

4. Your Responsibilities

It is the responsibility of ‘you’, the client, to check carefully when booking that you have the correct tour or package and travel date. There may be fees imposed to make changes to tours, packages or travel dates and in many instances all payments may be non-refundable. We strongly recommend all clients arrange suitable travel insurance which includes cancellation insurance at the time of making any travel bookings.

It is important that ‘you, the client supplies ‘us’ with the correct names of all travelers. These names must be supplied as they appear in your passport to allow us to book your hotels and any domestic flights that may be included in your tour package under the correct name(s). Any domestic flight tickets issued as part of your tour or package are issued based on the names you supply with your booking and are NON-Refundable. An amendment fee may be payable should they be issued in an incorrect name as supplied by ‘you’ the client. This fee is payable by ‘you’ the client to our local office in order to get any flight tickets amended. Should an amendment not be possible the cost of a new ticket will also be paid by ‘you’ the client. ‘We’ fully accept that if ‘we’ issue the tickets in the wrong name(s) when ‘you’ the client have supplied the correct names, ‘we’ will bear any costs related to amending your tickets. We request a copy of ‘your’ passports be sent to us after booking to ensure all names are used correctly.

5. Cancellation by the Client

Any cancellation by a client must be made in writing. The date on which Active Asia Limited receives the email will determine the cancellation charges applicable.
The cancellation charges below are a percentage of the total price, excluding insurance.

A/ Cancellation more than 60 days before departure: A per person cancellation fee of US$ 100 applies plus any non-refundable services, which may include any domestic air tickets, rail tickets or non-refundable hotel room nights.

B/ Less than 7 days before departure – 100% non-refundable.
Insurance is strongly recommended. Please note that once purchased your domestic airfares on any tour are non-refundable.

There is no refund for any unused travel arrangements after you have departed from your home country.

Any refunds will only be refunded back to the original credit card used to make the purchase.

6. Prices and Surcharges

All prices are correct to the best of our knowledge. Events beyond our control may result in price increases; We reserve the right to pass on these changes if necessary.

7. Flexibility

‘You’ should appreciate and acknowledge that the nature of travel in Asia may sometimes require flexibility and at times adjustments or changes may need to be made to tours and sightseeing. ‘You’ acknowledge that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice, due to local circumstances or events, which may include sickness, mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate and or other unpredictable or unforeseeable circumstances.

8. Charges

‘We’ reserve the right to change any of the facilities, services or prices described should it become necessary in the interests of safety or other unforeseen circumstances. ‘We’ guarantee to provide services equal to or exceeding those advertised if at all possible.

9. Travel Documents

‘You’ must be in possession of a valid passport and all visas, permits and insurance. It is ultimately ‘your’ responsibility to ensure you have the necessary documentation to allow you to travel too and enter the country. Your passport must be valid for 6 months from the departure date from Asia.
You should check with your local home country embassy or a reliable travel agent for any travel Visa requirements to allow you to enter the country you are visiting. Being denied entry into any country is no claim for any refund and all payments are non-refundable as per our cancellation policy.

10. Factors Outside our Control

‘We’ cannot accept any liability for matters outside our control such as political disputes, border closures, refusal of visas, industrial action, delayed flights, acts of terrorism, war or unforeseeable climatic changes.

11. Insurance

You’ are willing to accept full responsibility for insurance which must cover personal accident, medical expenses, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the client. It is strongly recommended that all clients have personal travel insurance.

12. Unused Services

There will be no refunds for any unused services.

13. Claims and Complaints

If ‘you’ have a complaint about any service or product supplied by ‘us’, ‘you’ must, if on a private or group tour, firstly inform your Tour Guide whilst on the tour so that they can attempt to rectify the problem. Any other or further complaint must be put in writing to ‘us’ within 30 days of the end of the tour. Any problem with your hotel room or facilities, you should first try to take the matter up with the hotel or supplier at the time of the problem. Failure to bring the problem to the attention of the local hotel or operator may forfeit any possibility of a refund or resolve to the problem. Any concerns should be brought to our attention, in writing, within 30 days.
